These Terms and Conditions ("Agreement") are a legal agreement between you ("User" or "Customer") and Eurasia Digital LLC ("Merchant"), governing the use of the www.elv-almanack.co.uk website and the payment for the services offered by the Merchant. 1.1 Eurasia Digital LLC offers access to a system designed to manage vehicle recycling businesses ("Services"). These Services may include but are not limited to, inventory management, sales tracking, reporting, and customer support.

1.2 Eurasia Digital LLC will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of the United Arab Emirates.

Payment Obligations:

2.1 Payment: By accessing the www.elv-almanack.co.uk member's site and utilizing the Services, you agree to pay the applicable fees as specified on the website to Eurasia Digital LLC.

2.2 Payment Method: We accept payments online using Visa and MasterCard credit/debit cards in the currency of GBP pound sterling. Multiple transactions may result in multiple postings to the cardholder’s monthly statement.

2.3 Payment Confirmation: Once payment has been received, an email will be sent to the account holder's email address with a copy of a receipt for in-app purchases or a copy of the invoice for subscription payments.

2.4 Billing Cycle: The fees for the Services will be billed in advance on a recurring basis, typically monthly. In addition, in-app purchases will be charged at the time of purchase. You agree to pay your bill within 7 days of the date of issue. For outstanding invoices older than 30 days we reserve the right to charge interest on the debt at a rate of 3% above the UAE base rate. Where invoices are not settled within the 7 days we reserve the right to suspend your service without notice.

2.5 Taxes: Unless we indicate otherwise, all charges are quoted without VAT and any other taxes of a similar nature, which shall be charged and payable by you at the prevailing rate.

Refunds and Cancellations:

3.1 Refunds: All subscription sales are final therefore once payment has been made, access to our services are instant and all content will be presumed as downloaded. The subscription lasts for a minimum term of 30 days.

3.2 Cancellation: All subscription services provided by Eurasia Digital LLC via ‘www.elv-almanack.co.uk’ have a minimum term of 30 days. To cancel a subscription you must give written notice to [email protected]. Your account will be closed and no further payments will be requested unless the account is in arrears.

3.3 Discretionary refunds: In cases where Eurasia Digital LLC agree a refund for a subscription payment, such as a good will gesture, refunds will be made onto the original mode of payment and will be processed within 10 to 45 days depending on the issuing bank of the credit card.

3.4 In app purchases will be deducted from your account balance. Once purchased, all content will be presumed as downloaded and consumed. Only in the event of the content downloaded being incorrect/invalid, could a balance refund be requested. In such cases, please email [email protected] with a request to review. If granted, balance refunds will take up to 24 hours to be reflected in your account balance.

Refunds and Cancellations:

4.1 Refunds: Due to the nature of the digital services provided, we do not offer refunds for subscriptions unless no access has yet been granted to our software services. Once the purchase has been made and the service has been accessed, the services will be presumed as downloaded and consumed.

Suspension and Termination:

5.1 We may suspend our service to you if:
a.) You break the terms of this agreement;
b.) We are instructed to do so by an authorised Government agency, emergency service organisation, or other authorised organisation.
Under these circumstances:
a.) We will endeavour to give you 14 days written notice.
b.) We are not liable to pay you compensation
5.2 Termination: Almanack may terminate this Agreement without notice if there is a breach of these terms and conditions or where invoices are not settled within the 7 days.

Intellectual Property:

6.1 Ownership: All intellectual property rights, including copyrights, trademarks, and patents, relating to the Almanack website and the Services, shall remain the sole property of Eurasia Digital LLC which is located in the United Arab Emirates.
6.2 License: By using the Services and making the required payments, Almanack grants you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes only. Your account should only be accessed by person/s inside of the company subscribed. User is responsible for maintaining the confidentiality of their account.

Disclaimer of Warranties:

Almanack provides the Services on an "as is" and "as available" basis. The Merchant does not guarantee that the Services will be error-free, uninterrupted, or secure. You acknowledge and agree that your use of the Services is at your own risk.

Limitation of Liability:

The liability of the Merchant, including its affiliates, directors, officers, employees, agents, and suppliers, shall be limited to the extent permitted by law. The Merchant shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use or inability to use the Services.

Dispute Resolution:

Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the United Arab Emirates.

Age Restriction:

Customers who are minors or under the age of 18 shall not register as users of the website or transact on or use the website.

Transaction Records and Confidentiality:

The cardholder must retain a copy of transaction records and Merchant policies and rules. Users are responsible for maintaining the confidentiality of their accounts.

The Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, Customers are encouraged to frequently visit these sections in order to stay updated about the changes on the website. Modifications will be effective on the day they are posted.
